Terms of Service

1. Adults Only

GenSpicy is an adult service. You must be at least 18 years old and legally permitted to access adult-themed content in your location. Before you can generate anything, you confirm that you are 18 or older and accept these Terms and our Content Policy. We record that confirmation on our servers with the date and the version of the terms you accepted. If you sign up with Google, continuing with Google counts as that confirmation. If these terms change in a way that needs your agreement again, we will ask you before your next generation.

2. Your Account

You are responsible for keeping your credentials secure and for activity performed through your account. Information you provide must be accurate. You may not share access with a minor or use the service on behalf of a prohibited user.

3. Permitted Use

GenSpicy is intended for original, lawful, adult-themed, non-explicit creative expression within the AI provider's content rules. You are responsible for your prompts, uploads, outputs, and how you use or distribute them. Upload only media you own or have permission to use, and never upload images of a real person without their consent.

4. Prohibited Content

You must not create, upload, request, store, or distribute:

• Pornographic or sexually explicit content, including nudity and sexual acts, whether real or fictional (prohibited by WaveSpeed AI)
• Any sexualized depiction of a person under 18, including fictional, generated, or age-ambiguous characters
• Non-consensual sexual content, sexual violence, exploitation, trafficking, or coercion
• Sexual content that impersonates or depicts an identifiable real person without documented consent
• Incest, bestiality, extreme violence, or content promoting illegal activity
• Content that infringes privacy, publicity, copyright, trademark, or other rights
• Malware, scams, harassment, or attempts to bypass safety systems

We may block prompts or outputs, suspend accounts, preserve relevant records, and report apparent illegal content where required by law.

5. Your Content

You retain any rights you hold in the content you submit. You grant us the limited rights needed to process, store, moderate, display to you, and deliver that content as part of the service. Your generated and uploaded media are private to your account inside GenSpicy; we do not publish them. AI outputs may not be unique, and their ownership or eligibility for copyright protection may vary by jurisdiction.

6. Credit Packs and Payments

GenSpicy sells one-time credit packs only. The price and the number of credits in each pack are shown before purchase. There are no memberships, subscriptions, or automatic renewals. Purchased credits do not expire. Pack prices are retail prices and are separate from how generation is costed.

Each generation costs credits based on the AI provider's quoted price for the exact model and settings you choose: 10 credits for every US$0.01 of the provider's quoted cost. The credit cost is shown before you submit. The credits are reserved when you submit and charged only after the provider finishes and the result is saved to your library. A task that definitively fails or expires returns its reserved credits. If the provider's status for a submission is unknown, the credits stay reserved while we reconcile it, so you are never charged twice. Your credit history shows each reservation, charge, and return.

Payments are processed by the payment provider you choose at checkout. Used credits are generally non-refundable except where required by law or stated in our Refund Policy.

The current provider's Terms of Service apply to every model. Model names or safety configuration options do not override these rules.

7. Referral Program

Signed-in adults can share a personal referral link from their account.

• Attribution: when someone opens your link, a first-party cookie remembers your referral code for 30 days. The first valid referral link a visitor opens is the one that counts. No referral is recorded if the visitor rejected optional cookies. The visitor must then create a new GenSpicy account; existing accounts cannot be referred, and you cannot refer yourself.
• Commission: you earn a commission of 20% of the amount paid for the referred account's first verified, paid one-time credit pack purchase made in US dollars. Later purchases and purchases in other currencies earn no commission.
• What you see: your referral page shows each referred account by a masked email address (for example a***@example.com), its referral status, and the commission recorded for it.
• No automatic payout: commission is an accounting record in your account, not a withdrawable balance, and we do not pay it out automatically. Any payout arrangement would be agreed separately in writing.
• Reversal: if the referred purchase is refunded or charged back, its commission is reversed.
• Abuse: we may withhold or reverse commission and close referral access for self-referral, fake accounts, spam, misleading promotion, or other abuse. We may change or end the program at any time; commission already recorded for verified purchases stays visible in your account.

8. Service Availability

AI generation may sometimes fail, take longer than expected, or produce an unwanted result. We may change models, limits, features, or pricing to keep the service safe and sustainable.

9. Termination

You may stop using the service at any time. We may restrict or terminate access for violations, risk to others, chargebacks, fraud, or legal requirements.

10. Disclaimers and Liability

The service is provided on an "as available" basis to the extent permitted by law. GenSpicy is not responsible for decisions made from generated content or for unlawful use by a user. Nothing in these terms excludes rights or liabilities that cannot legally be excluded.

12. Governing Law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Subject to mandatory consumer law, disputes shall be brought in the state or federal courts serving Sheridan County, Wyoming.
